Implementation of Capitalist Economic System and Following International Law
will Always Deprive us from Treasures like Reko Diq
On 12th July 2019, the tribunal of the International Center for Settlement of Investment Disputes (ICSID) gave a verdict in a case which was filed by TCC against the cancellation of mining rights in Reko Diq which is part of Baluchistan province. The tribunal ordered Pakistan to pay almost 6 billion dollars to TCC as penalty for cancelling her contract. After the announcement of this verdict a discussion has emerged across the country that the verdict of the Supreme Court of Pakistan in 2013, which cancelled the contract with TCC, may be a popular verdict but it damaged the confidence of foreign investors and now Pakistan has to bear financial loss as well because of the verdict of the international tribunal.
If the Khilafah (Caliphate) on the method of the Prophethood had been established in Pakistan, this problem would not have arisen at all. Islam declares mineral resources as public property and mandates that the state looks after their mining, processing of ore and their sale, and whatever wealth is generated through such resources must be used for the welfare of the people as they are the actual owners of these resources. According to this command of Islam oil, gas and mineral resources can never be privatized and handed over to a local or foreign company and such companies cannot work on these resources as owners of these resources. Therefore Islam mandates the state to look after the management of mineral resources on behalf of the people.
The Bajwa-Imran regime constituted a commission on this matter which is purely a deception because the attorney general of the regime welcomed the statement of the parent company of TCC in which it showed willingness to resolve the matter of mining contract of Reko Dik through negotiations. Also the attorney general said that Pakistan took its international legal obligations seriously. It means that the regime is going to use the verdict of international tribunal to hand over the world’s fifth largest gold mine to international investors. So a foreign company will take the lion’s share of this wealth and Pakistan and its people won’t get anything except a few pennies. We already have the example of Saindak project in Baluchistan where a Chinese company has been mining copper for many years but Pakistan did not get any significant wealth from the project to change the fate of even the few thousand local people living in Saindak who are still living in poverty.
O Muslims of Pakistan!
The capitalist system passionately advocates the privatization of natural resources because of its belief in the “Freedom of Ownership”. This means that valuable treasures go in the hands of a small capitalist elite and the state and the people remain poor. The capitalist system through democracy ensures that companies of colonialist powers become the owners of treasures such as Reko Diq under the name of foreign investment. And at any time if the oppression of the colonialist companies is exposed and a conflict emerges between the foreign company and the oppressed country and its people then courts and tribunals established by colonialists will secure the interest of international colonialist companies. Such a state of affairs can only end when we abandon democracy and establish Khilafah (Caliphate) on the method of the Prophethood in Pakistan which will declare mineral and all natural resources as public property and international colonialist powers won’t be allowed to exploit and loot our wealth. And the Khilafah will reject and abandon international courts and law because Allah (swt) has not allowed Muslims to grant kuffar authority in their matters or to refer their disputes to Kuffar. Allah (swt) said,
﴿وَلَن يَجْعَلَ اللَّهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلًا﴾
“Allah (swt) does not permit the believers to grant the kuffar authority over them.” [Surah An-Nisa’a 4:141].

سرمایہ دارانہ معاشی نظام کانفاذ اور عالمی قوانین کی تقلید ہمیں ریکوڈک جیسے خزانوں سے محروم کرتے رہیں گے
12 جولائی 2019 کو ٹریبیونل آف دی انٹرنیشنل سینٹر فار سیٹلمنٹ آف انوسٹمنٹ ڈیسپیوٹس (ICSID) نےصوبہ بلوچستان میں ریکوڈک کے مقام پر کان کنی(Mining) کا معاہدہ منسوخ کرنے پر ٹی سی سی کمپنی کی جانب سے دائر کیے گئے مقدمے میں پاکستان کے خلاف فیصلہ دیتے ہوئے پاکستان کو تقریباً 6 ارب ڈالر ہرجانہ ادا کرنے کا حکم جاری کیا۔ اس فیصلے کے بعد سے ملک میں ایک بحث شروع ہو گئی ہے کہ 2013 میں سپریم کورٹ نے اس معاہدے کو غیر قانونی قرار دے کر ایک عوامی فیصلہ تو کیا تھا لیکن اس کی وجہ سے بین الاقوامی سرمایہ کاروں کا اعتماد مجروع ہوا اور اب ورلڈ بینک کے ٹریبیونل کے فیصلے کی وجہ سے پاکستان کو مالی نقصان بھی اٹھانا پڑے گا۔
اگر پاکستان میں نبوت کے طریقے پر خلافت قائم ہوتی تو یہ مسئلہ سرے سے پیدا ہی نہیں ہوتا ۔ اسلام معدنی ذخائر کو عوامی ملکیت قرار دیتا ہے اور ریاست پر لازم کرتا ہے کہ وہ معدنی ذخائر کی کان کنی، خام یعنی کچی دھات کی صفائی اور اس کی فروخت تک کے تمام معاملات کو اپنی نگرانی میں چلائے اور اس سے حاصل ہونے والی دولت کو عوام کی فلاح و بہبود پر خرچ کرے کیونکہ وہ ہی اس کے اصل مالک ہیں۔ اسلام کے اس حکم کے تحت تیل، گیس، معدنی وسائل کی نجکاری کسی صورت نہیں ہوسکتی یعنی کوئی نجی کمپنی، چاہے وہ مقامی ہو یا بیرونی ہو، ان وسائل پر حقِ ملکیت کے ساتھ کام نہیں کرسکتی۔ لہٰذا اسلام نے صرف اور صرف ریاست پر لازم کیا ہے کہ وہ عوام کے وکیل ہونے کی حیثیت سے معدنی وسائل کے امور کو براہ راست دیکھے اور چلائے۔
باجوہ-عمران حکومت کا ورلڈ بینک کے ٹریبیونل کے فیصلے پر کمیشن بنانے کا فیصلہ عوام کو دھوکہ دینے کے سوا کچھ نہیں ہے کیونکہ اس فیصلے کے بعد حکومت کے اٹارنی جنرل نے ٹی سی سی کمپنی کی پیرنٹ() کمپنی کی جانب سے معاملے کو مذاکرات کے ذریعے حل کرنے کے بیان کوخوش آئند قرار دیا اور کہا کہ پاکستان بطور ذمہ دار ریاست کے بین الاقوامی معاہدوں کو سنجیدگی سے دیکھتا ہے۔ یعنی حکومت ورلڈ بینک کے ٹریبیونل کے اس فیصلے کو جواز بنا کر ایک بار پھر دنیا کے پانچویں بڑے سونے کے ذخیرے کو بین الاقوامی سرمایہ کاروں کے حوالے کر دے گی جو اس ذخیرے سے حاصل ہونے والی دولت کا بہت بڑا حصہ لے جائیں گے اور پاکستان اور اس کی عوام کے حصے میں چند سکوں کے سوا کچھ نہیں آئے گا اور وہ غریب ہی رہیں گے۔ اس حوالے سے صوبہ بلوچستان میں سیندک کی مثال سامنے ہے جہاں چینی کمپنی سال ہا سال سے تانبے کی کان کنی کررہی ہے لیکن اس دولت سے اتنا حصہ بھی نہیں ملا کہ اگر پورے پاکستان کی نہ سہی کم ازکم سیندک کے چند ہزار لوگوں کی قسمت ہی بدل جاتی لیکن وہ لوگ آج بھی غربت کی زندگی گزار رہے ہیں۔
اے پاکستان کے مسلمانو!
سرمایہ دارانہ نظام “آزادیِ ملکیت” کے تصور کے تحت قدرتی وسائل کی نجکاری کا پُرزور حامی ہے جس کی وجہ سے بڑے بڑے خزانے چند سرمایہ داروں کے پاس چلے جاتے ہیں اور ریاست اور عوام غریب ہی رہتے ہیں۔ سرمایہ دارانہ نظام جمہوریت کے ذریعے اس بات کو یقینی بناتا ہے کہ غیر ملکی سرمایہ کاری کے نام پر ان خزانوں کے مالک استعماری ممالک کی کمپنیاں بن جائیں۔ اگر کبھی استعمار کا ظلم بے نقاب ہوجائے اور مظلوم ملک اور عوام اور بین لاقوامی سرمایہ کار کمپنی کے درمیان تنازعہ پیدا ہوجائے تو استعماری طاقتوں کی جانب سے بنائیں گئی عدالتیں استعماری سرمایہ دار کمپنیوں کومکمل تحفظ فراہم کرتیں ہیں ۔ اس صورتحال کا خاتمہ صرف اسی صورت ممکن ہے جب پاکستان میں جمہوریت کاخاتمہ کرکےنبوت کے طریقے پر خلافت قائم کی جائے جو معدنی وسائل کو عوامی ملکیت قرار دے گی جس کے بعد کوئی بین الاقوامی استعماری طاقت ہماری دولت کو لوٹ نہیں سکے گی۔ اور خلافت موجودہ بین الاقوامی یا عالمی عدالتی نظام کا بھی انکار کردے گی کیونکہ اللہ نے مسلمانوں کو اپنے معاملات میں نہ تو کفار کو کوئی اختیار دینے اور نہ ہی اپنے تنازعات کو کفار سے حل کرانے کی اجازت دی ہے۔ اللہ سبحانہ و تعالیٰ نے فرمایا،
وَلَنْ يَّجْعَلَ اللّٰهُ لِلْكٰفِرِيْنَ عَلَي الْمُؤْمِنِيْنَ سَبِيْلًا
”اللہ تعالٰی ایمان والوں کو اس بات کی اجازت نہیں دیتے کہ وہ کفار کو اپنےمعاملات پر اختیار دیں“ (النساء 4:141)۔
