…Thus, Hizb ut Tahrir/ Wilayah Pakistan Elaborates a Vision of Pakistan under the Islamic Khilafah (Caliphate) State

The Muslims of Pakistan want to see Pakistan as an Islamic State through their love for Allah (swt) and RasulAllah (saaw). Their desire for Islamic ruling is so intense and obvious, that secular and religious parties are making election promises that they will make Pakistan like the state of Al-Madinah al-Munawwara, if they come in power. However, the Muslims of Pakistan previously have been denied Islamic ruling many times through similar calls, such as the call for Nizam e Mustafa, Islamic Welfare State and Islamicisation. The Muslims of Pakistan have been stung many times before with false election promises because of the absence of their clear grasp of what the Islamic State looks like, its structure and the obligations and duties of the ruler and the citizens within it.

In such an environment, Hizb ut Tahrir/ Wilayah Pakistan has issued a manifesto for 1439/2018 entitled, “Pakistan, Khilafah and the Re-Unification of the Muslim World” so the Muslims of Pakistan have the structure and details of the Islamic State in their hands, by which to evaluate political parties. In the manifesto, Hizb ut Tahrir Wilayah Pakistan clarified to the Muslims a vision of Pakistan under the Khilafah (Caliphate). It elaborates upon the ruling, economic, social and systems, with Islamic evidences. It also gives insight into the education, foreign and media policies according to Islam. Some of the key concepts of the manifesto are as follows:

• Neither the Khaleefah nor the Council the Ummah have the authority to make laws according to their whims and desires. The ruler will be bound to implement laws from Quran and Sunnah, whilst the Council of the Ummah will account the ruler on the basis of Islam and advise him over the taking care of the affairs of the people.
• Oil, gas, electricity and minerals are public properties, whose benefit is for the community collectively. Their privatization and nationalization will be forbidden as Islam mandates.
• All non-Islamic taxation, such as income tax, general sales tax, property tax and withholding tax will be eliminated. Islam has its own unique laws for generating revenues, which will be implemented, with recourse to taxation upon the wealthiest only, if needed.
• Instead of foreign investment, domestic investment will be encouraged which will liberate the economy from dependency on foreign colonialist institutions.
• All interest based debt will be rejected. Indeed, their principal amounts have been paid many times over, yet there is no sign of relief from the debt trap due to the injustice of interest. Moreover, the destructive practice of taking foreign loans with interest and conditions will be stopped.
• Any citizen can become the owner of agricultural land, if he revives an unclaimed barren land.
• No ruler will have judicial immunity and any open violation of the Quran and Sunnah is a basis for their immediate dismissal by the Court of Unjust Acts.
• The focus of the foreign policy will be the propagation of Islam through Dawah and Jihad.

Hizb ut Tahrir/ Wilayah Pakistan requests that the Muslims study this manifesto, so that they become impervious to being stung again because of their firm grasp of their Deen and clear conception of its implementation as a state. And it calls upon the Muslims to participate in the struggle of Hizb ut Tahrir for the re-establishment of Khilafah (Caliphate) on the Method of Prophethood, so that the real change finally becomes a reality.

 حزب التحریر ولایہ پاکستان نے منشور جاری کردیا:

اصل تبدیلی حکمران جماعت کی تبدیلی نہیں بلکہ حکومتی نظام کی تبدیلی ہے،

حزب التحریر کی جانب سے خلافت کے نظام کا خاکہ اس امر کو واضح کرتا ہے

مسلمان پاکستان کو ایک اسلامی ریاست کے طور دیکھنا چاہتے ہیں اور امت کی یہ خواہش اس قدر شدید  اور واضح ہے کہ ملک کی سیکولر اور دینی جماعتیں اپنے انتخابی وعدوں میں اقتدار میں آنے کی صورت میں پاکستان کو ریاست مدینہ بنانے کا وعدہ کررہی ہیں۔ پاکستان کے مسلمانوں نے اس سے قبل بھی اسلام ،نظام مصطفیٰ، اسلامی فلاحی ریاست کے نام پر ایک سے زائد بار دھوکہ کھایا ہے۔ امت کے ساتھ ہر بار یہ دھوکہ اس لیے ہوجاتا ہے کہ اس کے پاس اس حقیقت کو جانچنے کا کوئی پیمانہ نہیں کہ اسلام کی ریاست کیسی ہوتی ہے ، اس کے خدوخال کیا ہیں اور اس میں  حکمران اور عوام کے کیا حقوق و فرائض ہوتے ہیں۔ اس صورتحال کو مدنظر رکھتے ہوئے حزب التحریر ولایہ پاکستان نے   عوام کو اس پیمانے سے روشناس کرانے کے لیے منشور جاری کردیا ہے جس کے بعد وہ اس بات کا ادراک کرسکیں گے کہ  اسلامی ریاستِ خلافت   کی ہیت اور تفصیلات کیا ہیں۔اس منشور میں حزب التحریر والایہ پاکستان نے پاکستان کے مسلمانوں  کے لیے واضح کیا ہے کہ پاکستان میں ریاست خلافت کے  قیام کے بعد حکومتی، معاشی، معاشرتی،عدالتی نظام اور تعلیمی پالیسی، خارجہ پالیسی اور میڈیا پالیسی کیا ہوگی۔  اس منشور کے کچھ چیدہ چیدہ نکات یہ ہیں:

1۔حکمران (خلیفہ)  اور مجلس امت کو اپنی مرضی کے مطابق قانون سازی  کا اختیارحاصل نہیں ہو گا۔ حکمران  قرآن و سنت کے قوانین کونافذ کرنے کاپابند ہوگا اور مجلس امت صرف اسلام کی بنیاد پرحکمران  (خلیفہ) کا کڑامحاسبہ کرے گی اور لوگوں کے امورکی دیکھ بھال میں اس کو مشورہ دے گی۔

2۔ تیل، گیس، بجلی ومعدنیا ت کو اسلام کے حکم کے مطابق عوامی ملکیت قرار دیا جائے گا ، جس سے حاصل ہونے والی منفعت میں پورے معاشرے کا حصہ ہے۔   ان کی نجکاری حرام ہوگی۔

3۔ تمام غیر شرعی ٹیکسوں جیسا کہ انکم ٹیکس، سیلز ٹیکس، پراپرٹی ٹیکس، ود ہولڈنگ ٹیکس، ایکسائز ٹیکس وغیرہ کا خاتمہ کردیا جائے گا۔اور ان کی جگہ اسلامی محاصل کا اجرا کیا جائے گا جو  عمومی طور پر ٹیکس کا بوجھ  صرف صاحب حیثیت لوگوں پر ڈالتے ہیں وہ بھی جب ان کی ضرورت ہو۔

4۔ بیرونی سرمایہ کاری کی جگہ اندرونی سرمایہ کاری  کی حوصلہ افزائی کی جائے گی جو معیشت کو بیرونی استعماری  ذرائع اور ادروں  پر انحصار سے آزاد کردے گی۔

5۔ وہ تمام قرضے جن کی اصل رقم کئی بار ادا کردینے کے باوجود بھی ختم نہیں ہورہے ان کاطوق اتار پھینکا  جائے گا اور غیر ملکی  قرضے لینا بند اور سود کی قسطوں کی ادائیگی کا انکار کردیا جائے گا۔

6۔ بے کار بے مالک زرعی زمین کو جو شہری  کاشت کر لے گا وہ اس کا مالک بن جائے گا۔

7۔ کسی حکمران کوکوئی عدالتی استثناء حاصل نہیں ہوگا اور قرآن سنت کی کسی بھی واضح حکم کی خلاف ورزی  پر اسے محکمہ مظالم کے ذریعے فوراً برطرف کردیا جائے گا۔

8۔ خارجہ پالیسی کامحور دعوت و جہاد کے ذریعے اسلام کی اشاعت ہوگا۔
