Panama Papers Saga Establishes Democracy Guards Corruption 

Real, Effective and Timely Accountability is Only Possible in

the Khilafah on the Method of the Prophethood

The demand for the resignation of the Prime Minister, Nawaz Sharif, is gaining momentum, after the submission of a report to the Supreme Court on the matter of Panama Papers probe by the Joint Investigation Team (JIT), on 10^th July 2017. The conclusion of JIT report is that the prime minister and his children have not established the money trail regarding assets, with living standards well beyond their declared assets and so the matter must be transferred to the National Accountability Bureau (NAB). Let no-one forget that in June 2012, the then Prime Minister, Yousuf Raza Ghilani, was disqualified by the Supreme Court, yet the government of Pakistan People’s Party (PPP) remained. Moreover, the new Prime Minister, Raja Pervaiz Ashraf, was appointed, even whilst he was under investigation for financial corruption by the NAB over kickbacks, whilst he was Minister for Water and Power! So, even if the Prime Minister of the Pakistan Muslim League-Nawaz (PML-N) is sent home, the ruling party can simply appoint another corrupt ruler to complete its turn. Truly, Democracy is the guardian of corruption.

Real, effective and timely accountability of rulers is not possible in Democracy or indeed any other man made system. As is seen around the world, through the Panama Papers and numerous other cases, Democracy provides ample loop holes to allow corrupt rulers to amass immense wealth through their access to power and funds, whilst concealing their corruption. Throughout the world, even after years of investigation and court trials, corrupt rulers are not convicted through lack of irrefutable evidence. Real, effective and on time accountability of those with access to power and funds of the state is only possible in the Khilafah on the Method of Prophethood, which implements the laws revealed by Allah )swt( and not the laws made by men. It is narrated by Abu Hamid Al-Sa’idi, the Prophet (saaw) employed a man from the tribe of Al-Azd named Ibn Lutbiyyah as collector of Zakat. When the employee returned (with the collections) he said: “O Prophet (saaw)! This is for you and this is mine because it was presented to me as gift.” The Messenger of Allah (saaw) rose to the pulpit and praised Allah and extolled Him. Then he (saaw) said:

مَا بَالُ الْعَامِلِ نَـبْـعَـثُـهُ فَيَأْتِي يَقُولُ هَذَا لَكَ وَهَذَا لِي فَهَلاَّ جَلَسَ فِي بَيْتِ أَبِيهِ وَأُمِّهِ فَيَـنْـظُـرُ أَيُهْدَى لَهُ أَمْ لاَ وَالَّذِي نَفْسِي بِيَدِهِ لاَ يَأْتِي بِشَيْءٍ إِلاَّ جَاءَ بِهِ يَوْمَ الْقِيَامَةِ يَحْمِلُهُ عَلَى رَقَـبَـتِـهِ إِنْ كَانَ بَعِيرًا لَهُ رُغَاءٌ أَوْ بَقَرَةً لَهَا خُوَارٌ أَوْ شَاةً تَيْعَرُ ثُمَّ رَفَعَ يَدَيْهِ حَتَّى رَأَيْنَا عُفْرَتَيْ إِبْطَيْهِ أَلاَ هَلْ بَلَّغْتُ ثَلاَثاً

“I employ a man to do a job and he comes and says: ‘This is for you and this has been presented to me as gift’? Why did he not remain in the house of his father or the house of his mother and see whether gifts will be given to him or not? By Allah in Whose Hand is the life of Muhammad, if any one of you took anything wrongfully, he will bring it on the Day of Resurrection, carrying it on (his back), I will not recognize anyone of you, on the Day of Resurrection with a grunting camel, or a bellowing cow, or a bleating ewe.” Then he raised his hands till we could see the whiteness of his armpits. Then he said thrice, ”O Allah ! have I conveyed (Your Commandments” [Bukhari and Muslim].

Hizb ut-Tahrir Wilayah Pakistan warns the Muslims of Pakistan that no good ever comes out of such anti-corruption dramas under Democracy. Before the current drama, the Musharraf’s martial law era “restoration of democracy” and the PPP’s “restoration of judiciary” never brought any good and corruption continued. Democracy will never bring any good in the future as well because every institution works according to the Kufr laws left by the British Raj. These dramas are meant to give you false hope in Democracy, so as to stop you from working for real change through the re-establishment of the Khilafah on the Method of Prophethood. Turn your back on Democracy’s dramas and expend all your efforts for the re-establishment of the Khilafah which is the only guarantor of real, effective and timely accountability of rulers.

حقیقی، موثر اور بروقت احتساب صرف

نبوت کے طریقے پر قائم خلافت میں ہی ممکن ہے

10 جولائی 2017 کو سپریم کورٹ میں پانامہ مقدمے کے حوالے سے پیش کی جانے والی جے آئی ٹی رپورٹ کے بعد وزیر اعظم نواز شریف کے استعفیٰ کا مطالبہ زور پکڑتا جا رہا ہے۔ جے آئی ٹی کی رپورٹ کا خلاصہ یہ ہے کہ وزیراعظم اور ان کے بچے اپنے اثاثوں کی منی ٹریل ثابت نہیں کر سکے اور ان کا طرز زندگی ان کے اعلان شدہ اثاثوں سے مطابقت نہیں رکھتا، لہٰذا مزید کارروائی کے لیے اس معاملے کو قومی احتساب بیورو (نیب) میں بھیجا جائے۔ یہ نہیں بھولنا چاہیے کہ جون 2012 میں اس وقت کے وزیر اعظم یوسف رضا گیلانی کو بھی سپریم کورٹ نے نااہل قرار دے کر اقتدار سے بے دخل کر دیا تھا لیکن حکومت پاکستان پیپلزپارٹی (پی پی پی) ہی کی برقرار رہی جس نے راجہ پرویز اشرف کو نیا وزیر اعظم بنا دیا جس کے خلاف پہلے سے قومی احتساب بیورو (نیب) پانی و بجلی کے وزیر کی حیثیت سے کی جانی والی مالیاتی کرپشن کی تحقیقات کر رہا تھا۔ لہٰذا اگر اس بار مسلم لیگ-ن کا وزیر اعظم گھر بھیج دیا جاتا ہے تو حکمران جماعت ایک اور کرپٹ حکمران نامزد کر دے گی اور اپنی باقی مدت پوری کر لے گی۔ یقیناً جمہوریت کرپشن کی نگہبان ہے۔

               درحقیقت جمہوری نظام یا انسانوں کے بنائے کسی بھی نظام میں حکمرانوں کا حقیقی، موثر اور بر وقت احتساب ممکن ہی نہیں۔ پانامہ پیپرز اور اس جیسے دوسرے معاملات سے یہ واضح ہوتا ہے کہ پوری دنیا میں جمہوریت کرپٹ حکمرانوں کو اتنے قانونی مواقع فراہم کرتی ہے کہ وہ آسانی سے حکومتی طاقت کو ریاستی اور عوامی وسائل کو لوٹنے کے لیے استعمال کرتے ہیں اور اپنی کرپشن کو چھپا بھی لیتے ہیں۔ پوری دنیا میں یہ بھی دیکھا گیا ہے کہ سالوں تک تحقیقات اور عدالتی کارروائی چلنے کے بعد بھی کرپٹ حکمران اس لیے مجرم قرار نہیں دیے جاتے کیونکہ مکمل ثبوت موجود نہیں ہوتے۔ اُن لوگوں کا حقیقی، موثر اور بروقت احتساب جن کی رسائی حکومتی طاقت اور وسائل تک ہے صرف اور صرف نبوت کے طریقے پر قائم ریاست خلافت میں ہی ممکن ہے جو انسانوں کے بنائے ہوئے قوانین کو نہیں بلکہ اللہ سبحانہ و تعالیٰ کے قوانین کو نافذ کرتی ہے۔ ابی حمید الساعدی سے روایت ہے کہ رسول اللہ ﷺ نے الأزد قبیلے سے ایک شخص ابن اتبیہ کو زکوۃ جمع کرنے کے لیے مقرر کیا۔ جب وہ زکوۃ جمع کر کے واپس رسول اللہ ﷺ کے پاس پہنچے تو انہوں نے کہا: “اے نبی ﷺ! یہ آپ (بیت المال) کے لیے ہے اور یہ میرا ہے جو مجھے تحفے میں دیا گیا ہے”۔ تو رسول اللہ ﷺ منبر پر کھڑے ہوئے، اللہ سبحانہ و تعالیٰ کی تعریف کی اور فرمایا:

مَا بَالُ الْعَامِلِ نَـبْـعَـثُـهُ فَيَأْتِي يَقُولُ هَذَا لَكَ وَهَذَا لِي فَهَلاَّ جَلَسَ فِي بَيْتِ أَبِيهِ وَأُمِّهِ فَيَـنْـظُـرُ أَيُهْدَى لَهُ أَمْ لاَ وَالَّذِي نَفْسِي بِيَدِهِ لاَ يَأْتِي بِشَيْءٍ إِلاَّ جَاءَ بِهِ يَوْمَ الْقِيَامَةِ يَحْمِلُهُ عَلَى رَقَـبَـتِـهِ إِنْ كَانَ بَعِيرًا لَهُ رُغَاءٌ أَوْ بَقَرَةً لَهَا خُوَارٌ أَوْ شَاةً تَيْعَرُ ثُمَّ رَفَعَ يَدَيْهِ حَتَّى رَأَيْنَا عُفْرَتَيْ إِبْطَيْهِ أَلاَ هَلْ بَلَّغْتُ ثَلاَثاً

“ایک اہلکار جسے میں نے بھیجا کیوں واپس آ کر یہ کہتا ہے کہ ‘یہ آپ کے لیے اور یہ مجھے تحفے میں دیا گیا ہے’؟ وہ کیوں نہ اپنے باپ یا اپنی ماں کے گھر میں رہتا اور دیکھتا کہ پھر اسے یہ تحفے ملتے ہیں یا نہیں؟ اس ذات کی قسم جس کے قبضے میں میری جان ہے، اس مال (زکوۃ) میں سے اگر کوئی بھی ناجائز طریقے لے لے گا تو قیامت کے دن اسے وہ اپنی گردن پر اٹھائے ہوئے ہو گا۔ اگر اونٹ ہے تو وہ اپنی آواز نکالتا ہوا آئے گا، گائے ہے تو وہ اپنی اور اگر بکری ہے تو وہ اپنی آواز نکالتی ہو گی۔ پھر آپ ﷺ نے اپنے ہاتھ اٹھائے یہاں تک کہ ہم نے آپ ﷺ کی بغل مبارک کی سفیدی بھی دیکھ لی اور تین بارفرمایا اے اللہ! کیا میں نے تیرا حکم پہنچا دیا” (بخاری و مسلم)۔

               پاکستان کے مسلمانوں کو حزب التحریر ولایہ پاکستان خبردار کرتی ہے کہ ان جمہوری تماشوں سے آپ کے لیے کوئی خیر برآمد نہیں ہو گا۔ موجودہ تماشے سے قبل مشرف کے مارشل لاء دور میں “جمہورت کی بحالی” اور پھر پی پی پی کے دور میں “عدلیہ بحالی” تحریک سے آپ کے لیے کوئی خیر برآمد نہیں ہوا اور کرپشن ویسے ہی چلتی رہی۔ جمہوریت مستقبل میں بھی آپ کے لیے کسی خیر کا باعث نہیں بنے گی کیونکہ اس نظام کے تحت تمام ادارے برطانوی راج کے چھوڑے ہوئے کفریہ قوانین کے تحت کام کرتے ہیں۔ ان تماشوں کے ذریعے جمہوری نظام سے آپ کی امیدیں وابستہ رکھنے کی کوشش کی جاتی ہے تا کہ آپ کو نبوت کے طریقے پر خلافت کے قیام کے ذریعے حقیقی تبدیلی لانے کے لیے کام کرنے سے روکا جائے۔ لہٰذا خود کو ان جمہوری تماشوں سے دور رکھیں اور اپنی تمام تر توانائیاں نبوت کے طریقے پر خلافت کے قیام پر لگا دیں کیونکہ حکمرانوں کا حقیقی، موثر اور بروقت احتساب ریاست خلافت میں ہی یقینی ہے۔
